UNSW Underwater Club
The University of New South Wales Underwater Club (UWC) is an affiliate of Arc Sport UNSW. It aims to provide an organised sporting environment that is free from harassment, discrimination and bullying where all those involved in its activities are treated with dignity, equality and respect. Discrimination, harassment and bullying are extremely distressing, offensive, humiliating and may create an uncomfortable and unpleasant environment. Discrimination, harassment and bullying are against the law. Those involved in the UWC cannot enjoy themselves if such behaviour is present in any form.
This code of conduct is designed to ensure that all those participating in UWC activities understand the correct manner in which to behave at all times, to ensure that all participants have a relaxed and enjoyable experience. All participants involved in social sports shall by means of their participation recognise and agree to be bound by the code of conduct. Any breach of this code is regarded as a serious matter by the UWC and disciplinary action may be enforced against a person(s) in breach of this code.
Codes of Conduct:
- Always remember this is a recreational sport and we are all here to have fun!
- Be a good sport. Always encourage everyone including less experienced member who may need a little more guidance.
- Treat all participants in the sport as you would want to be treated. Do not bully or take unfair advantage of member
- Cooperate with the executive, the committee, event organisers and boat drivers. Without them there would be no UWC.
- Respect the rights, dignity and worth of all participants regardless of their gender, ability, cultural background or religion.
- Control your temper. Verbal abuse of officials and sledging other members, deliberately distracting or provoking an opponent are not acceptable or permitted behaviours in any sport.
- Any physical altercations and unnecessary physical aggression will not be tolerated.
- Condemn the use of violence in any form, no matter who it occurs between.
- Do not mix alcohol with sport. Participants will not be permitted to take part if they are suspected of being under the influence of alcohol or any illegal substances.
- Leave all areas used by the UWC tidy and free from litter or other mess.
Conduct deemed foul play may include but is not limited to…
Verbal abuse and/ or threatening actions towards any participants, physically abusive behaviours, verbal abuse based on race, religion, culture, ethnicity, sexual orientation or otherwise any other acts (not previously referred to) which are contrary to points 1-8 above.
Offending parties may be immediately ejected from the event and banned for a nominated period of time. UWC may at its sole discretion exclude a participant or team from further events where it is deemed that the conduct of a player or team is sufficient to warrant exclusion.
General Risk Warning, Release of Liability and Waiver of Claims:
In consideration of the UWC permitting me to participate in its activities and sports, permitting me the use of its equipment and permitting me the use of its facilities, I hereby agree as follows:
1. ASSUMPTION OF RISKS:
- 1.1) I am aware that participating in the activities and sports offered by or associated with the UWC may involve the risk of injury or harm including, but not limited to those associated with participating in sport, exercise and/or physical activity. I freely accept and fully assume all inherent risks, dangers and hazards and the possibility of personal injury, death, property damage or loss resulting there from.
- 1.2) To waive any and all claims that I have or may have in the future have against the UWC and its directors, employees, agents and representatives.
- 1.3) To Release the UWC, and its directors, officers, employees, agents and representatives from any and all liability for any loss, damage, injury or expense that I may suffer or that my next of kin may suffer, as a result of my participation in activities and sports offered by the UWC, due to any cause whatsoever including negligence, breach of contract, breach of statutory duty of care, and/ or breach of occupier’s liability on the part of the UWC, and its directors, officers, employees, agents and representatives.
- 1.4) To hold harmless and indemnify the UWC, and its directors, officers, employees, agents and representatives from any and all liability for any property damage or personal injury to any third party, resulting from my activities and my participation in the activities offered by or associated with the WC.
2. Media Release:
- 2.1) I give permission for the UWC, its agents or anyone authorised by Arc @UNSW to photograph or film me, or record my voice.
- 2.2) I understand any such photograph, film or recording of myself is the property of the UWC and Arc @UNSW and may be used for the sole purpose of advertising, publicity, public displays and exhibitions.
- 2.3) I voluntarily waive any cause of action against the UWC and Arc @UNSW, its agents or anyone authorised by theUWC and Arc @UNSW for defamation, invasion of privacy, breach of moral rights, copyright or trademark violation, right or publicity, or right to payment of any kind arising out of or in connection with the use of any photograph, film or recording of myself by the UWC and Arc @UNSW .
- 2.4) I acknowledge that the UWC and Arc @UNSW may use any photograph, film or recording of myself or not as they choose, without affecting the validity of this release.
3. I state that I am in a fit physical and mental condition to participate in this event/activity and am aware that participation could, in some circumstances, result in physical injury.
4. That this Agreement shall be effecting and binding upon any heirs, next of kin, executors, administrators and assigns in the event of my death.
5. Refund Policy:
- 5.1) The UWC does not give refunds unless in cases of extenuating circumstances - these will be assessed on a case-by-case basis
Please note that your contact information may be exchanged with members of the club for the purpose of organising a diving trip.
Medical quesstionaire
I confirm that I have completed the following Diver Medical Participant Questionnaire developed by the Diver Medical Screeen Committee (2020) and, if required, I have recieved the included physician's medical evaluation confirming my fitness to dive. I understand that I may be required to provide confirmation of this prior to undertaking scuba diving, and freediving activities with the UNSW Underwater Club. If I cannot provide this confirmation, I confirm that I will not undertake these activities.

Membership Cancellation
Section 2 of the Underwater Club constitution addresses membership rights (2.6) and grounds for termination (2.9-11):
2.6 The rights afforded under a membership or associate membership include the following:
2.6.1 The right to participate in social events held by and on behalf of the club;
2.6.2 The right to participate in dive events held by and on behalf of the club;
2.6.3 The right to vote at meetings; and
2.6.4 The right to hire club gear subject to limitations and penalties agreed upon by the gear officer(s) and/or members of the Executive that are made known to members upon hire.
2.9 A member or associate member of a club may have their membership terminated upon breach of any clause of this Constitution or any relevant regulations, including but not limited to the failure to pay any moneys owed to the club, after the following procedure is followed:
2.9.1 Giving the accused Member the opportunity to explain and/or remedy the breach prior to the discontinuance of their member ship, for which such opportunity is not to be unreasonably withheld
2.9.2 A motion is carried by the Executive, or the Executive is petitioned by fifteen (15) members to instigate impeachment proceedings;
2.9.3 The members of the club are notified of the proceedings formally as a motion on notice to an Extraordinary General Meeting under Section 4.2;
2.9.4 The member concerned is notified in writing of the procedures and reasons for proceedings at least seven (7) days prior to the meeting.
2.9.5 The member concerned is given five (5) minutes to speak against the motion at the Extraordinary General Meeting.
2.9.6 The motion is carried by the Extraordinary General Meeting.
2.9.7 A Member who has paid all arrears of fees payable to the Club may resign or withdraw from membership of the Club by giving four (4) weeks’ notice, in writing, to the Club.
2.10 Any member of a club or club Executive who believes they have been wrongly expelled may appeal to Arc, who will arrive at the final resolution of the matter.
2.11 Membership fees or subscriptions paid by the discontinued Member are forfeited to the Club upon discontinuance.
Acknowledgments:
1. I will abide by the Constitution, Rules and Affiliation agreement of the UWC
2. I will treat UWC property and equipment made available for my use with appropriate care and will return it punctually to the UWC in the same condition as lent (fair wear & tear excluded).
3. I understand that I use all club gear, including dive computers at my own risk.
4. I will abide by the reasonable directions of Executive members, dive leaders, boat handlers and diving organisers of the Club while participating in UWC Activities.
5. I understand that concealment of any condition incompatible with safe diving might put my or others’ lives or health at risk.
6. I will promptly advise any changes or additions to the information appearing above.
7. I agree that I will take responsibility for my own actions and safety and to ensure that I am medically fit to dive.
AGREEMENT:
I hereby certify that through the online registration processes that I have read, understood and agree to these terms. I am waiving certain legal rights which I or any heirs, next of kin, executors, administrators and assigns may have against the UWC and ARC@UNSW and its directors, officers, employees, agents and representatives
