Majestic Calisthenics Club Terms and Conditions
We or us means Majestic Calisthenics Club;
CAWA means the Calisthenics Association of Western Australia, the governing body of all calisthenics clubs in Western Austrlia
Carer means you or the person chosen by you to attend classes with the pupil;
Coach means the person employed by Majestic Calisthenics Club to teach the classes;
Class assistance means the person employed by Majestic Calisthenics Club to assist the coaches with the teaching of the classes;
Committee Member means an ndividual who is a recognised member of the Majestic Calisthenics Club committee;
Booking/Registration form means the enrolment form which you have completed.
Fee means the price of the classes, as applicable from time to time;
Premises means the place where the class takes place;
Pupil or Member means the child named on the Booking/Registration form;
Term means a period of up to 12 weeks (as applicable), starting with the first class of that period;
You means the parent or legal guardian who has completed the booking/registration form for a pupil and is responsible for the payment of the fees for that pupil.
1. Acceptance of Terms and Conditions
1.1 All agreements relating to the teaching of the classes to the Pupil are subject to these terms to the exclusion of all other terms and conditions.
1.2 No variation or addition to the terms shall be binding unless agreed in writing by Majestic Calisthenics Club.
1.3 By signing onto the abovementioned membership, you have read, understood and hereby agree to the policies, procedures and rules of the Club. The member and parent/s agrees to abide by the Club's Rules & Purposes, members policies and procedures.
1.4 Membership is not refundable or transferable to another individual.
2. Responsibility
2.1. You confirm that you are the parent or legal guardian with responsibility for the pupil. You agree that you or a carer will attend each class with the pupil and will ensure a carer collects the pupil from class, unless expressly agreed in advance before a class commencing.
2.2. You confirm that the information set out in the Booking/Registration form is accurate in all material respects and that you will inform us of any changes immediately.
2.3 The Majestic Calisthenics Club provides either a digital or booklet form of the Club Handbook that outlines all policies and procedures of the club. It is the parent or legal guardian's responsibility to ensure they have obtained a copy of the Club Handbook and that they have read and familiarised themself with all policies and procedures as outlined within the Handbook.
2.4. You will indemnify us and keep us indemnified against all loss, liability, costs and expenses which we may incur directly as a result of any actions of a carer or the pupil.
3. Health and Safety
3.1. You must inform Majestic Calisthenics Club and our Coaches of any medical condition or injuries that the pupil may have before the start of the Term or each class, as applicable. If you have any health concerns which may have an effect on participation in the classes, it is advisable that you consult your GP before attending.
3.2. It is the carer's sole responsibility that the pupil is dressed properly according to our guidelines in our Club Handbook. The coach reserves the right at all times to refuse the player with clothing or accessories which may have a safety concern for the pupil and his/her team-mates.
3.3. It is the carer's sole responsibility to ensure that medical equipment, medication and relevant Emergency Action Plans are made available to Majestic Calisthenics Club as required and that the administration of medication or medical equipment is clearly communicated in writing to Coaches or Committee Members as required. You will indemnify us and keep us indemnified against all injury, loss, liability, costs and expenses which may be incurred directly as a result of any actions in regards to the administration of medication or medical equipment.
3.4 At the time of enrolment, all members must complete a Competing or Non Competing Affiliation Form which provides membership to the Calisthenics Association of Western Australia (CAWA). The completion of Affiliation and the payment of an Affiliation fee is compulsory. All Affiliated members will receive basic insurance coverage provided by CAWA.
3.5 CAWA insurances may cover participation in some Club activties but is not liable for injuries, medical treaments including transportation by Ambulance in all club activities or sports. The responsiblity of treatment rests with the participant/ member.

4. Absenteeism
4.1. It is the pupil's best interest to keep up attendance. There is no refund or credit for any missed or absent classes.
4.2 Majestic Calisthenics club reserves the right to cancel the membership of any pupil who continues to miss classes and exhibit high rates of absenteeism.
4.3 Majestic Calisthenics Club reserves the right to withdraw students from concerts or competitions where the stuent is not prepared or practised due to lack of attendance. Coaches of the Club reserve the right make decisions in regards to pupil inclusion in concerts and competitions.
5. Fees and Payment
5.1. You shall pay us the Fees for a complete Term within seven (7) days of receipt of your Invoice. Majestic Calisthenics Club reserves the right to cancel entry to competitions or concerts, or to cancel membership in full due to unpaid fees.
5.2. Term, camp and other associated fees are neither refundable nor transferable.
5.3. Eligible families are encouraged to apply for Kidsport Funding through the Department of Local Government, Sport and Culture https://www.dlgsc.wa.gov.au/funding/sport-and-recreation-funding/kidsport
5.4. Families experiencing difficulties with Term fee payments or other required fees are directed to contact the Treasurer of the Club to seek assistance.
5.5. No refunds shall be given for classes which have been missed by the pupil nor credits given in exchange for future classes.
5.6. In the event of illness or medical condition of the pupil which causes irregular attendance, the Majestic Calisthenics Club and Coaches must be notified. Adjustment of fees based on ongoing medical treatment or issues will be at the discretion of Majestic Calisthenics Club.
5.7 If registration occurs during the season or term, member agrees to pay full term/ season fees regardless of how many classes or training sessions have been attended. Majestic Calisthenics Club reserves the right to adjust fees at its discretion.
5.8 Term fees will be sent as an Invoice via the email address provided by the parent or legal guardian. Email addresses must be kept current and should be checked regularly. Majestic Calisthenics Club accepts no responsibility for missed invoices where an incorrect email address has been provided or where emails are not regularly checked and read.
6. Changes or Cancellation by Us
6.1. We reserve the rights to cancel your enrolment at any time before the start of any term. In such event we will refund the fees paid for that term.
6.2. We reserve the rights to change the coach taking the classes at any time.
6.3. Classes held during Term may be impacted by Calisthenics events such as competitions and concerts involving members of our Club. The dates of competitions and concerts are assigned by CAWA and are not in the control of Majestic Calisthenics Club. At times, this may result in the cancellation of training classes. In the event of a clash with a Calisthenics event, the class will be cancelled by text and/or email using the details held on file. Where cancellations of classes occur, the coaches will endeavour to provide alternative training classes. Provision of alternative classes are dependent upon the availability of suitable dates and times, suitable premises, and coaches' availability. Pupils are encouraged to attend these classes, if they are made available. Where classes are cancelled due to circumstances beyond Majestic Calisthenics Club's control, no refund or credit shall be issued.
6.4. A permanent change in the location or time of a class will constitute a change of these conditions and will be notified accordingly.
6.5. We may change these conditions at any time. We will endeavour to give you as much notice as possible in the event of any changes.
6.7. We cannot accept liability or pay compensation if we are forced to cancel or in any way make changes to your term or session due to any condition or any other reason outside our control or any other disruptions caused by third party contractors.
7. Changes or Cancellation by You
7.1. Majestic Calisthenics Club does NOT refund the term fee as your pupil's space is reserved for the duration of the term when Majestic Calisthenics offers you a space and a full term fee is received.
7.2. Once the term has started, any cancellation requested by you due to your holiday arrangements, moving house, going abroad or any other matter of your personal nature are considered cancelled by you, and therefore no refund will be given. Ongoing absence may result in the cancellation of the pupil's membership.
8. Refund Policy
8.1. No Attendance = No Refund
8.2. Once the term has started there will be no refund given for any changes or cancellation by you regardless of the attendance of the player.
9. Discipline and Inappropriate Behaviour
9.1. If we decide that the pupil’s or carer’s behaviour is unacceptable, we are entitled to exclude the pupil and/or the carer from a class or the premises for any period that we may decide is appropriate. Unacceptable behaviour shall include damage to property, disruptive behaviour, any form of verbal or physical aggression towards the coach, class assistants, committee members, or other pupils, or any other behaviour as we reasonably determine.
9.2. If your pupil or the carer is excluded from the class for the reasons mentioned, our liabilities to you cease to exist and Majestic Calisthenics Club will be under no obligation to offer any kind of refund or compensation whatsoever.
9.3 The member agrees not to physically or verbally harass other club members, including members of the club committee, coaches, class assistants and parents. Any disputes should be raised via email to the club committee in the first instance.
10. General
10.1. The failure by either party to enforce any of these conditions shall not be a waiver of them.
10.2. These conditions, together with the Affiliation Form and Booking/Registration Form, constitute the entire agreement between you and Majestic Calisthenics Club.
10.3. You agree that these conditions will apply to the classes run by Majestic Calisthenics Club and attended by the pupil. By making payment of the fee and the pupil attending the classes, you are deemed to have accepted these conditions.
10.4. These conditions shall be governed by Australian law and shall be subject to the jurisdiction of the Australian courts.
