Terms and Conditions for the use and hire of DSC training boats and equipment.

1. At such times that they are not required for scheduled training activities, boats from the DSC training fleet are available for charter to be used in Club events such as racing or recreational purposes.

2. OTB boats will only be available for hire when rescue boat facilities are available.

3. Hire arrangements must be made at least 24hrs prior to use.

4. Hire payment must be made at the time of application to confirm the hire.

    1. A damage waiver, or arrangement to draw on a debit or credit card is required. The damage waiver is $1,000. If there is damage caused to the boat beyond normal wear and tear, the cost of repairs shall be deducted from the bond including a $100 administration fee. Examples of damage considered not to be normal wear and tear include (but are not limited to): a. Collision
    1. Running aground
    2. Negligent care of boat (including failure to adopt correct rigging practices)

 

    1. Should DSC’s insurance provider decline a claim, the hirer will be responsible for the full extent of damage costs.
    2. All hirers require must hold or be assessed as meeting qualification standards appropriate to the craft for which they are applying to hire.
    3. All hirers must obtain and return the Club’s equipment through a member of the Club’s sailing staff.
    4. All damage and defects or losses which occur during the hire period must be reported to the Club’s sailing staff via the online Log and Maintenance Report on return of the boat. Any damage not covered by the club’s insurance policy and deemed to be caused as a result of negligence by yourself, will be determined by the Club’s Sailing Manager or Instructors and additional costs may be incurred by you.
    5. All hirers must sign on and sign off when leaving and returning to the beach.
    6. If hiring a boat for an organised Club race, the boat will be available 1 hour prior to the race and must be unrigged, washed, cleaned and stowed away no later than 1 hour after the race.
    7. All hirers must follow instructions stipulated by the Club’s Sailing Manager or Instructors relating to the designated sailing area, safety precautions relating to the prevailing conditions and adhere to the pre-determined time schedule.

13. Hirers are responsible for the chartered vessel throughout the period of the charter, including, where applicable, on land, rigging & de-rigging. They are the only persons to use the vessel during the charter period.

14. In case of late return, rescue or assistance, the cost of the use of the safety boat will be deducted from your bond ($80).

15. All hirers must wear appropriate safety gear relevant to the conditions of the day, including but not limited to, sun protection and stinger protection.

16. All hirers must wear an approved Life Jacket (at least 50N) and helmet if deemed necessary, at all times whilst on the water. These can be provided by the Club.

17. All hirers must be a Full Member of the Darwin Sailing Club or of an Australian Sailing affiliated club.

 

Warning

Participation in this activity can be inherently dangerous. Risks include but are not limited to overexertion, equipment failure, dehydration, serious accidents, weather conditions, water quality and threat from marine life, which may result in you and/or the above named person being personally injured, and/or your/their property being damaged. This warning has been voluntarily read and understood and I and/or the above-named person accept and assume the inherent risks associated with participating in this activity/course.

Fitness to Participate

I declare that I and/or the above-named person are medically and physically fit and able to participate in this activity/course. I and/or the above-named person must not and will not be a danger to ourselves or jeopardise the safety and health of others.

Photography

I acknowledge that photographs and video recordings may be taken of the above-named persons throughout the duration of this activity. I understand and agree that The Darwin Sailing Club Inc. has the right to use any media images obtained throughout this activity for promotional purposes.

Privacy:

I understand that the information provided in this form is necessary for the conduct of this activity/course. I acknowledge and agree that this information will only be used by The Darwin Sailing Club Inc. to facilitate the conduct of this activity and other activities organised by The Darwin Sailing Club Inc.

 

I acknowledge and agree to these terms and conditions which are outlined above. I also acknowledge, agree and understand that The Darwin Sailing Club Inc. will take all reasonable care, but in the case of personal injury or loss of life to the above named, or the loss and/or damage to his/her property, howsoever arising, I/we do hereby release, to the full amount permitted by statute, law and equity The Darwin Sailing Club Inc., its employees and agents, from all actual and contingent liability in respect of such personal injury, loss or damage.
